FL-105 DECLARATION UNDER UNIFORM CHILD CUSTODY JURISDICTION AND ENFORCEMENT ACT

When a individual files for divorce in California they must file a divorce petition. However, another form that must be filed with the California family law court is the FL-105 if the parties to the divorce of minor children. The FL-105 requires specific information about the minor child or children including the following;

  • Child's name
  • Date of Birth
  • Place of Birth
  • Sex
  • All address of residence in which the minor children have lived
  • Listing of any other family law matters that included the minor children in which a court had jurisdiction including domestic violence actions, guardianship, and adoptions.
  • The listing of any other person not party to the action that may claim custody or visitation over the minor children.

At the bottom of the Fl-105 there is a Notice to the Declaration that the declaration must keep the court in which the Fl-105 is filed of any custody or other family law matter in which the minor children are involved. The FL-105 is an important document because it allows the California family law court to assert jurisdiction over the minor children that are listed in the form.
